Plantopia Terms of Service

Plantopia is operated by Graviton AI (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Plantopia mobile application and related services (collectively, “Plantopia”). By accessing or using Plantopia, you agree to these Terms.

Eligibility and Accounts

Depending on how you use Plantopia:

  • You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Plantopia.

  • Plantopia may create an anonymous account when you first use the app, or you may register and sign in with an email address or supported sign-in provider.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Use of Plantopia

Plantopia provides tools to identify plants from photos, generate AI-powered care schedules and health assessments, track watering and care tasks, and log plant progress.

You agree not to:

  • Use Plantopia for any unlawful, harmful, or fraudulent purpose.

  • Upload content that is illegal, infringing, offensive, or unrelated to legitimate use of the service.

  • Attempt to reverse-engineer, disrupt, scrape, or bypass security or usage limits of Plantopia or its backend services.

  • AI-Generated Recommendations & Toxicity Disclaimer

Plantopia uses artificial intelligence (including OpenAI) to identify plant species, assess plant health, and suggest care routines.

  • Informational Purposes Only: AI plant identifications, health checks, and care recommendations may be inaccurate, incomplete, or unsuitable for your specific environment. They do not constitute professional horticultural, agricultural, pest-control, medical, or veterinary advice.

  • No Consumption or Toxicity Guarantee: Never ingest, touch, or expose children or pets to any plant based on Plantopia’s identification or information. Always consult a qualified poison-control, medical, veterinary, or botanical professional regarding plant toxicity or safety.

  • Plant Health Risk: You assume full responsibility for how you care for your plants. We are not liable for plant damage, disease, or loss resulting from reliance on Plantopia’s suggestions or reminders.

User Content and Photos

  • Ownership: You retain ownership of the photos, plant notes, and information you submit to Plantopia (“User Content”).

  • License to Operate the Service: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely as needed to provide, maintain, secure, and improve Plantopia (including transmitting photos and plant details to our cloud and AI service providers such as Google Firebase and OpenAI).

  • Sharing Features: If you choose to share plant profiles or photos using Plantopia’s sharing features, you are responsible for the content you share.

Subscriptions and Billing

  • In-App Purchases: Certain features of Plantopia (such as Plantopia Plus / Pro features, expanded plant limits, or AI health scans) may require a paid subscription or in-app purchase.

  • Google Play Billing: All purchases and subscriptions are processed by Google Play. Billing, renewals, free trials, and refunds are governed by the Google Play Terms of Service.

  • Auto-Renewal & Cancellation: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your Google Play Store account settings. Deleting your Plantopia account or uninstalling the app does not automatically cancel an active Google Play subscription.

Intellectual Property

Plantopia, including its design, branding, logos, illustrations, software, and content (excluding your User Content), is owned by Graviton Technologies Inc and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial use in accordance with these Terms.

Termination

You may stop using Plantopia at any time and may request account deletion within the app or by contacting us at nsoni@gravitonai.info. We may suspend or terminate your access if you violate these Terms, abuse the service, or if required for legal or security reasons.

Disclaimers and Limitation of Liability

  • “As Is” Service: Plantopia is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

  • Limitation of Liability: To the fullest extent permitted by law, Graviton Technologies Inc and its affiliates, officers, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of plants, data, profits, or goodwill arising out of or related to your use of Plantopia. Our total aggregate liability for any claim arising out of these Terms or Plantopia shall not exceed the amount you paid to us for Plantopia in the twelve (12) months preceding the claim, or $20 USD, whichever is greater.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the effective date. Your continued use of Plantopia after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Graviton Technologies Inc is incorporated, without regard to conflict-of-law principles.
